4. Datenschutz-Information für Bewerbende

Die Einhaltung datenschutzrechtlicher Vorgaben hat einen hohen Stellenwert für uns. Nachfolgend möchten wir Sie über die Erhebung und Verarbeitung Ihrer personenbezogenen Daten informieren:

Zweck und Rechtsgrundlage der Datenverarbeitung:

Wir verarbeiten Ihre personenbezogenen Daten zum Zweck der Entscheidung über die Begründung des Beschäftigungsverhältnisses. Im Rahmen des Bewerbungsverfahrens verarbeiten wir die personenbezogenen Daten, insbesondere Ihre Kontaktdaten, wie Ihren Namen und Ihre Anschrift, sowie alle mit der Bewerbung in Verbindung stehenden Daten, wie z.B. Lebenslauf, Zeugnisse, Qualifikationen. Sofern Sie einen Antrag auf Reisekostenerstattung stellen, benötigen wir darüber hinaus auch Ihre Bankverbindungsdaten. Die Rechtsgrundlage für die Verarbeitung Ihrer Daten ergibt sich aus Art. 88 DSGVO in Verbindung mit § 26 Abs. 1 S. 1 BDSG bzw. Art. 6 Abs. 1 S. 1 lit. b DSGVO.

Daneben erheben und verarbeiten wir personenbezogene Daten, die Sie uns freiwillig mitteilen. Die Verarbeitung dieser Daten erfolgt auf der Grundlage Ihrer widerrufbaren Einwilligung gemäß Art. 6 Abs. 1 Satz 1 lit. a, Art. 7 DSGVO in Verbindung mit § 26 Abs. 2 BDSG.

Talentpool:

Sofern es nicht zu einer Einstellung gekommen ist, Ihre Bewerbung aber weiterhin für uns interessant ist, fragen wir Sie möglicherweise, ob wir Ihre Bewerbung für künftige Stellenbesetzungen weiter vorhalten dürfen. Diese längere Aufbewahrung erfolgt auf der Grundlage Ihrer widerrufbaren Einwilligung gemäß Art. 6 Abs. 1 S. 1 lit. a, Art. 7 DSGVO in Verbindung mit § 26 Abs. 2 BDSG. Die Aufnahme in unseren Talentpool ist freiwillig und eine Nichterteilung der entsprechenden Einwilligung hat keine Auswirkungen auf andere laufende Bewerbungsverfahren.

Empfänger Ihrer Daten:

Ihre Daten behandeln wir selbstverständlich vertraulich und übermitteln diese nicht an Dritte.

Ggf. setzen wir streng weisungsgebundene Dienstleister ein, die uns z. B. in den Bereichen EDV oder der Archivierung und Vernichtung von Dokumenten unterstützen und mit denen gesonderte Verträge zur Auftragsverarbeitung geschlossen wurden. Wir übermitteln Ihre Daten nicht an Stellen außerhalb der EU bzw. des EWR.

Speicherdauer/Kriterien für die Festlegung der Speicherdauer:

Soweit keine gesetzliche Aufbewahrungsfrist existiert, werden die Daten gelöscht, sobald eine Speicherung nicht mehr erforderlich bzw. das berechtigte Interesse an der Speicherung erloschen ist. Sofern keine Einstellung erfolgt, ist dies regelmäßig spätestens drei Monate nach Abschluss des Bewerbungsverfahrens bzw. nach Zugang der Absage der Fall. Wir löschen Daten auch, wenn Sie Ihre Einwilligung in die Verarbeitung Ihrer Daten widerrufen.

Bewerbungen, die wir in den Talentpool aufgenommen haben, speichern wir für ein Jahr. Danach werden die Unterlagen gelöscht. Ihre Einwilligungserklärung zur Aufnahme in unseren Talentpool bewahren für drei weitere Jahre zur Einhaltung unserer Rechenschaftspflichten i.S.d. Art. 5 Abs. 2 DSGVO auf. In Einzelfällen kann es zu einer längeren Speicherung von einzelnen Daten kommen (z.B. Reisekostenabrechnung). Die Dauer der Speicherung richtet sich dann nach den gesetzlichen Aufbewahrungspflichten bspw. aus der Abgabenordnung (6 Jahre) oder dem Handelsgesetzbuch (10 Jahre). Eine weitergehende Speicherung Ihrer Daten ist zudem zulässig, sofern die Weiterverarbeitung nach erfolgter Interessenabwägung von uns zur Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen erforderlich ist.

Automatische Entscheidungsfindung:

Da die Entscheidung über Ihr Beschäftigungsverhältnis nicht ausschließlich auf einer automatisierten Verarbeitung beruht, findet keine automatisierte Entscheidung im Einzelfall im Sinne des Art. 22 DSGVO statt.

Ihre Datenschutzrechte:

Sie haben das Recht, auf Antrag unentgeltlich Auskunft über die zu Ihrer Person gespeicherten personenbezogenen Daten zu erhalten (Art. 15 Abs. 1 DSGVO). Zusätzlich haben Sie bei Vorliegen der gesetzlichen Voraussetzungen ein Recht auf Berichtigung (Art. 16 DSGVO), Löschung (Art. 17 DSGVO) und Einschränkung der Verarbeitung (Art. 18 DSGVO) Ihrer personenbezogenen Daten sowie auf Datenübertragbarkeit (Art. 20 DSGVO).

Sie haben das Recht, Ihre Einwilligung jederzeit mit Wirkung für die Zukunft zu widerrufen, wenn die Daten auf Grundlage von Art. 6 Abs. 1 S. 1 lit. a oder Art. 9 Abs. 2 lit. a DSGVO verarbeitet werden.

Compliance with data protection regulations is of great value to our company. In accordance with Art. 13 GDPR, we would like to inform you about the way we collect and process your personal data when you apply for one of our open positions.

Data required for the application process and applicant selection:

As part of the application process, we may ask you to complete an Application Questionnaire. With the help of the questionnaire, we collect personal data which we require for the application process and applicant selection.

In particular, this includes your contact details, such as your name and address, as well as all data related to the application, such as your CV, references, and qualifications. If you submit an application for reimbursement of travel expenses, we may also need your bank details.

The legal basis for the processing of your data is Art. 88 GDPR in conjunction with § 26 (1) (1) German Federal Data Protection Act (hereinafter BDSG). If you voluntarily provide us with additional personal data, we process this on the basis of your revocable consent in accordance with Art. 6 (1) (a), Art. 7 GDPR in conjunction with § 26 (2) BDSG.

We only process the personal data that you provide to us within the application process.

Data erasure:

If there is no legal retention period, the data will be erased as soon as it is no longer necessary to store it or the legitimate interest in storing it has expired. If you are not hired, this is usually no later than three months after completion of the application process or after receiving a rejection of your application. We also erase your data if you withdraw your consent.

In certain cases, data may be stored for a longer period of time (e.g., travel expense reports). The duration of retention depends on legal storage obligations, which may for example stem from the German Fiscal Code (6 years) or the German Commercial Code (10 years). Further storage of your data is also permitted if further processing is necessary to assert, exercise, or defend legal claims.

Talent pool:

If you are not hired, but your application is still of interest to us, we will ask you whether we may continue to keep your application for future vacancies. This longer retention is based on your revocable consent in accordance with Art. 6 (1) a, Art. 7 GDPR in conjunction with § 26 (2) BDSG.

Participating in our talent pool is voluntary. If you choose not to consent, this will not impact any ongoing application processes. Applications that we included into our talent pool are stored for one year. After that, the data will be erased.

Your declaration of consent will be stored for 3 more years in compliance with our accountability obligations in accordance with Art. 5 (2) GDPR.

Recipients of your data:

Needless to say, we treat all your data confidentially and do not transfer it to third parties.

If necessary, we appoint data processors who are strictly bound by documented instructions and who support us e.g., in the areas of IT or the archiving and destruction of documents, and with whom separate data protection agreements have been signed.

Your rights:

As a data subject, you have the right of access to personal data concerning you (Art. 15 GDPR), as well as the right to rectification to have inaccurate data corrected (Art. 16 GDPR). You also have the right to erasure if one of the reasons mentioned in Art. 17 GDPR applies, e.g., if the data is no longer needed for the aims pursued. Furthermore, you have the right to restriction of processing if one of the conditions listed in Art. 18 GDPR applies and, in the cases of Art. 20 GDPR, the right to data portability.
